By accessing or using Kontrakk ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time. Continued use of Kontrakk after changes are posted constitutes acceptance of the revised terms. We will notify registered users of material changes via email.

2. Description of Service

Kontrakk is a search and discovery platform for government contracts and grants. The platform aggregates publicly available opportunity data from SAM.gov (federal contracts) and Grants.gov (federal grants) and presents it through a unified interface. Kontrakk also provides AI-assisted tools including NAICS code detection, proposal draft generation, eligibility assessments, and compliance matrices to help users pursue opportunities more effectively.

3. User Accounts and Registration

To access certain features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep your account information up to date. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

Kontrakk offers tiered subscription plans with varying levels of access to platform features. Payment is processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to paid features through the end of your current billing period. No prorated refunds are issued for partial billing periods.

Refunds: Refund requests are evaluated on a case-by-case basis. If you believe you were charged in error, contact us at [email protected] within 14 days of the charge.

5. Acceptable Use Policy

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use automated tools (bots, scrapers, crawlers) to access the Service without prior written consent
• Resell, redistribute, or sublicense access to the Service or its data
• Misrepresent your identity or affiliation when using the Service

6. AI-Generated Content Disclaimer

Kontrakk provides AI-assisted features including proposal drafts, eligibility assessments, NAICS code recommendations, and compliance matrices. These outputs are generated by artificial intelligence and are intended as starting points to assist your workflow. They do not constitute legal, financial, or professional advice. You are solely responsible for reviewing, verifying, and editing all AI-generated content before submission or reliance. Kontrakk makes no guarantees regarding the accuracy, completeness, or suitability of AI-generated outputs.

7. Data Sources Disclaimer

Kontrakk aggregates contract and grant data from publicly available federal databases, primarily SAM.gov and Grants.gov. While we refresh this data daily and strive to present it accurately, the accuracy, completeness, and timeliness of the data depends on the source agencies. Kontrakk is not a government agency and is not affiliated with or endorsed by SAM.gov, Grants.gov, or any federal entity. Users should verify opportunity details directly with the issuing agency before taking action.

8. Intellectual Property

The Kontrakk platform, including its design, logo, user interface, and proprietary software, is owned by Kontrakk and protected by applicable intellectual property laws. Government contract and grant data displayed on the platform is publicly available and not claimed as proprietary by Kontrakk. Content you create or upload through the Service (such as saved proposals) remains your property. By using the Service, you grant Kontrakk a limited license to process your content solely for the purpose of providing the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Kontrakk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, loss of profits, data, business opportunities, or goodwill. Kontrakk's total liability for any claim arising from these terms or your use of the Service shall not exceed the amount you paid to Kontrakk in the twelve months preceding the claim. The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these terms, fraudulent activity, or conduct that harms other users or the Service. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account data by contacting us. Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and disclaimers) will remain in effect.
